What Is Adjustment of Status?

Adjustment of Status (AOS) is the process by which a person already in the United States applies to become a lawful permanent resident (green card holder) without having to return to their home country for a consular interview.

This process is available to people who have an approved immigrant petition — whether through family, employment, or other pathways — and who meet the eligibility requirements to adjust their status while remaining in the U.S.

The primary form used is Form I-485, Application to Register Permanent Residence or Adjust Status. But this form is just the beginning. A successful AOS case involves multiple filings, biometric appointments, potential interviews, and careful documentation.

Who May Qualify?

Being physically present in the United States at the time of filing, being admissible to the U.S. as an immigrant, having an approved immigrant visa petition with an immediately available visa number, having entered the country in a lawful manner in most cases, and not having certain bars to adjustment that might apply based on immigration history.
